Abstract

The paper analyses the content and implications of the revised Environmental Impact Assessment (EIA) Directive, with an aim to observe the strengths and weaknesses of the renewal from a Finnish perspective. It focuses on the new definition of EIA, environmental impact assessment report (EIA report) and the new monitoring requirement. The article shows that the revised Directive provides a legal push for strengthening the role of the competent authority as a reviewer of the EIA report and an impartial body that draws crucial conclusions on the significant impacts of the project. This is an important improvement that will decrease the risk of biased outcomes in EIAs. Also mandatory monitoring is a clear enhancement introduced by the renewal that serves for controlling the actual impacts of the project and developing assessment methods. The article identifies the new requirements on the EIA report as challenging part of the implementation. Due to unclear wording of the Directive, completeness and quality of the EIA reports will likely lead to legal debates and appeals. Legal unpredictability may have harmful impacts on the core qualities of EIA, such as transparency and public participation and communication among the stakeholders beyond legal norms.

Zusammenfassung

Der Artikel analysiert den Inhalt und die Auswirkungen der UVP-Änderungsrichtlinie auf das finnische UVP-System. Dabei werden die Stärken und Schwächen aus finnischer Sicht betrachtet. Der Artikel konzentriert sich auf die neue Definition von UVP, auf den UVP-Bericht und die Anforderungen an die Überwachung. Die Rolle der zuständigen Behörde, die den UVP-Bericht kontrolliert und als unparteiische Stelle die Erheblichkeit der Umweltfolgen bewertet, wird gestärkt. Dies ist eine wichtige Verbesserung, durch die die Gefahr von voreingenommenen Ergebnissen minimiert wird. Auch die obligatorische Überwachung stellt eine klare Verbesserung dar. Sie dient dazu, die tatsächlichen Umweltfolgen zu kontrollieren und die Prognose- und Bewertungsmethoden zu verbessern. Die größte Herausforderung sind die neuen Anforderungen an den UVP-Bericht. Aufgrund des unklaren Wortlauts der Richtlinie wird es hier wahrscheinlich zu Streitigkeiten und Gerichtsverfahren kommen. Rechtsunsicherheit kann die Hauptvorteile der UVP schmälern, nämlich größere Transparenz und verbesserte Beteiligung der Öffentlichkeit und Kommunikation zwischen Interessenvertretern über Rechtsnormen hinaus.
