Zusammenfassung

Aufgrund der UVP-Änderungsrichtlinie der EU von 2014 haben sich Bund und Länder mit der Neufassung des UVPG zur Schaffung zentraler Anlaufstellen im Internet für die Bereitstellung von UVP-Informationen verpflichtet. Dies soll einer effektiveren Öffentlichkeitsbeteiligung dienen, umgesetzt in Form von UVP-Portalseiten von Bund und Ländern. Zur Einführung dieser Portale beleuchten wir, wie die Umweltfolgenabschätzung und die Öffentlichkeitsbeteiligung eigentlich zusammenkamen, und weisen auf etablierte Beispiele für Informations- und Beteiligungsportale hin. Im Anschluss werden die rechtlichen Grundlagen für UVP-Portale in Deutschland und die aktuelle Umsetzung beschrieben und diskutiert. Um das volle Potenzial dieser Instrumente nutzen zu können, werden darüber hinaus Möglichkeiten zur fachlichen Nutzung der Portale sowie weitere Anregungen zur Effektivierung der Öffentlichkeitsbeteiligung in Deutschland umrissen. Als Ergebnis der Betrachtungen kann angeführt werden, dass die UVP-Portale zwar wichtige erste Schritte darstellen, zu einer Verwirklichung der ursprünglichen Idee des „Rechts auf Wissen und Beteiligung“ aber noch weitere Schritte folgen müssten.

Abstract

Due to the EU amendment of the EIA Directive of 2014, the Federal Government and the Länder have committed themselves to creating central access points on the internet for the provision of EIA information. This is to serve a more effective public participation, implemented as EIA portals for federal and state governments. To introduce these portals, the article examines how environmental impact assessment and public participation actually came together and point to established examples of information and participation portals. Subsequently, the legal basis for EIA portals in Germany and their current implementation is described and discussed. To be able to use the full potential of these instruments, possibilities for the professional use of the portals and further suggestions for making public participation in Germany more effective are also outlined. Based on the authors’ reflections, it can be stated that the EIA portals represent important first steps, but that further steps would have to follow, if the intended idea of the "right to know" were to be realised.
