Zusammenfassung

Im Mai 2017 wurde im Baugesetzbuch mit § 13b eine bis Ende 2019 (Aufstellungsbeschluss) bzw. Ende 2021 (Festsetzung) befristete Möglichkeit eines Bebauungsplans eingeführt, der Wohnungsbau im Außenbereich ermöglicht. Voraussetzungen sind u. a. das Anschließen des Plangebiets an den Innenbereich und eine Überbauung von höchstens 10.000 m² Grundfläche. Dabei werden die beim Bebauungsplan der Innenentwicklung nach § 13a BauGB mit dem beschleunigten Verfahren geschaffenen Erleichterungen genutzt. Infolge der geringen Größe der überbauten Flächen entfällt die Umweltprüfung nach UVPG; der Flächennutzungsplan kann anschließend berichtigt werden. Da eine Verlängerung dieser Regelung zu befürchten ist, wird die Planungspraxis untersucht. Es ist festzustellen, dass vor allem kleinere Gemeinden diese Möglichkeiten nutzen; häufig besteht der Verdacht eines Missbrauchs dieses Planungsinstruments.

Abstract

In May 2017, the new article 13b of the Federal Building Code introduced the possibility to draw up a binding land-use plan in undeveloped outskirt areas. This possibility is limited to a specific period (public notice of the resolution on the preparation of a land-use plan by the end of 2019 and adoption of the binding land-use plan as a statute by the end of 2021). Requirements to be met are the proximity to the developed area and less than 10,000 m² of land to be built upon. The procedural requirements are simplified according to article 13a of the Federal Building Code. Due to the small size of the built-up areas, an environmental assessment is no longer required. The preparatory land-use plan is corrected. Since an extension of this regulation now is to be feared, the article looks at the planning practice. It is noted that especially smaller municipalities make use of these opportunities and it is suspected that there is misuse.
